7405 -RESOLUTION OF CLAIMS
As part of and in accordance with its risk management program, the Board delegates the following authority to resolve legal claims arising from school system activities when settlement is in the best interest of the school system based on an assessment of the merits of the claim, the availability of potential defenses, the anticipated costs of litigation, and other relevant factors.
The Superintendent or designee is authorized to resolve claims for injury to persons or property by payment of a sum not to exceed $10,000.
A risk management review committee shall be established to consider and resolve claims in excess of the Superintendent's authority. The risk management review committee will have four members, composed of the Associate Superintendent for Administrative Services, the Assistant Superintendent of Human Resource Services, the Assistant Superintendent of Operational Services, and the Executive Director of Finance, or equivalent senior administrative positions in these areas as designated by the Superintendent. The committee is authorized to resolve all claims by payment of a sum within the self-insurance retention of the risk management program, not to exceed $50,000.
The Superintendent or designee and the risk management committee shall act in consultation with legal counsel for the Board in evaluating and settling claims and shall follow guidelines for resolution of claims that are consistent with the requirements of state and federal law.
Workers' Compensation Claims
Workers' compensation claims will be processed in accordance with the requirements of applicable state law and regulations. The Superintendent or designee and the risk management committee are authorized to approve final settlement and release of any workers' compensation claim within the limits set forth in this policy for the resolution of claims.
