6250 -FACILITY CONSTRUCTION AND REPAIR - AMERICANS WITH DISABILITIES ACT COMPLIANCE

All new school system construction shall be designed and constructed such that it is readily accessible to and usable by disabled individuals in compliance with the Americans with Disabilities Act. The Superintendent shall review as often as practicable each of the school system's services, programs and activities to ensure that, when each program is viewed in its entirety, it is accessible to disabled persons. If a service, program, or activity is not accessible, the Superintendent, subject to approval by the Board, shall take steps to make the service, program or activity accessible. This may include alteration of a building, service, program or activity, unless doing so would result in a fundamental change in the nature of the service, program or activity, or pose an undue financial burden on the Board.
42 U.S.C. 12101 et seq; 29 U.S.C. 794 et seq.
Adopted Effective: July 1, 1999
