4206 -CONFIDENTIALITY OF STUDENT RECORDS

Apart from directory information, personally identifiable information about a student shall not be released from a student's record without the prior written consent of the parent/guardian or emancipated student, except to the following persons:

4206.1 School personnel who have a proper educational purpose in examining the information contained in a student's record, including professionals contracted to provide services or consultation regarding a student;

4206.2 Officials of other schools and school systems in which the student has enrolled or intends to enroll, unless the parent/guardian or emancipated student has specifically requested in writing that the information not be released to the requesting institution;

4206.3 Authorized representatives of state and federal educational institutions or other authorized officials who have a legitimate reason for reviewing a student's records;

4206.4 Persons acting under a lawful court order or subpoena, but only within the limits of their legal authority and provided that the parent/guardian or emancipated student shall be notified of the request for release prior to release of the records under this exception.

4206.5 Financial aid organizations, if the release is in connection with a student's application for receipt of financial aid;

4206.6 State and local officials or authorities authorized to review student information pursuant to state statute if the disclosure concerns the juvenile justice system's ability to serve, before adjudication, the student whose records are released. Before releasing information under this paragraph, the official to whom the information will be disclosed must certify in writing that the information will not be disclosed to any other party, except as provided by state law or with prior written consent of the student's parent.

4206.7 Accrediting organizations, to the extent necessary to allow them to carry out their accrediting functions; and

4206.8 Appropriate persons in connection with an emergency, if the release of the information is necessary to protect the health or safety of the student or other persons.

Prior written consent for the release of personally identifiable information must be signed and dated by the parent/guardian or emancipated student and must specify the records that may be disclosed, the purpose of the disclosure, and the party or class or parties to whom the disclosure may be made.
