A student shall be assigned to the appropriate school in the attendance zone where the student's parent/guardian or custodian is domiciled, in accordance with the Durham Public Schools Student Assignment Plan.

A student shall be assigned to the appropriate school in the attendance zone where the student's parent/guardian or custodian is domiciled, in accordance with the Durham Public Schools Student Assignment Plan, unless the student has been assigned to another school in the district through the appropriate application/assignment process (e.g. magnet school, year-round school, transfer, special interest high school program).

4130.1 Change of Residence During the School Year

A student who moves from one DPS attendance zone to another during the school year will be permitted to remain in the student's original school for the rest of the school year, unless the best interest of the school or student dictates otherwise. Durham Public Schools will not provide transportation for students who choose to remain at their original school for the rest of the school year.

4130.2 Pending Change of Residence

Students who will move from one DPS attendance zone to another may submit a request for a transfer to the appropriate non-magnet school in the second attendance zone. Such transfer will be approved only if the student will move within 90 days after submission of the transfer request. The application for transfer must include an affidavit from the builder, lessor, prior owner or other knowledgeable person attesting to details of the pending move.

4130.3 Administrative Assignment

The Superintendent or designee may administratively assign a student to any non-magnet school in the system when the Superintendent or designee determines that such action is in the best interest of the student and schools affected, and that such action would not contravene the overall intent of the Board's school assignment policies.
