4115 -SCHOOL ADMISSION
Students will be admitted to the Durham Public Schools as described below.
4115.1 Students Entitled to Admission
Students are entitled to admission to the Durham Public Schools if they meet the following requirements:
A. the student meets legal age requirements and has not completed the prescribed course of study for graduation from high school;
B. the student has satisfied North Carolina immunization requirements;
C. the student is domiciled within Durham County, or is a homeless student living in Durham County, or lives with an adult who is a domiciliary of Durham County and has satisfied all requirements of G.S. 115C-366(a3); and
D. the student is not presently under suspension or expulsion from a private or public school in North Carolina or any other state.
The admission of a student who meets the qualifications of the McKinney-Vento Homeless Assistance Act will not be denied or delayed due to the absence of required enrollment records or documents.
4115.2 Out-of-District Students
A student who is domiciled outside the school district may be admitted within the discretion of the board. The student must apply for admission by June 1 before the school year in which the student seeks admission and, if he/she is a North Carolina resident, must be released from the school system where he/she is domiciled. The student also must meet the requirements of subsections 4110.1A., B., and D. Admissions of out-of-district students are for one school year only and the student must reapply for each school year.
A. Children of School Employees
Children of school system employees who are domiciled outside the school district will be admitted if the students qualify under Section 4115.1 (A), (C), and (D) if space is available at an appropriate school. Children of school system employees will not be charged tuition.
B. Other Students
Other students who are domiciled outside the school district may be admitted to the Durham Public Schools if space is available and if admitting the student does not adversely affect the board’s diversity goals.
4115.3 Tuition
Except for the children of school system employees, students who are domiciled and reside outside of the school district will be charged tuition in the same amount as the per pupil county appropriation from the prior fiscal year. The tuition rate will be determined and reported to the board not later than May 1 of each year.
4115.4 Verification of Age
The parent/guardian of a child who is making initial entrance into school must furnish a valid copy of the child’s birth certificate of other acceptable proof of age.
4115.5 Parental Statement Required for Transfer Students
When a student transfers to the Durham Public Schools, a parent/guardian or custodian must provide a statement made under oath or affirmation before a qualified official indicating whether the student is, at the time, under suspension or expulsion from attendance at a private or public school in this or any other state or has been convicted of a felony in this or any other state. This requirement does not apply to a student who has never enrolled in or attended public or private school.
