1505 -LEGAL DEFENSE OF SCHOOL BOARD MEMBER OR EMPLOYEE

The Durham Public Schools Board of Education may provide for the legal defense of a civil or criminal action brought against a Board member if a majority of the Board finds it is in the best interest of the school system to do so. Authority to make a like determination on behalf of a school employee is assigned to the Superintendent.

1505.1 Cost of defense may be offered only if the Board member or employee was sued or charged in connection with acts or omissions made in the course and scope of the person's duties as a Board member or employee.

1505.2 Cost of defense in criminal matters may be provided only if it appears that the Board member's or employee's action or omission was not because of fraud, corruption or malice on the part of the Board member or employee.
